{"id":1546,"date":"2024-11-05T22:28:00","date_gmt":"2024-11-05T21:28:00","guid":{"rendered":"https:\/\/sud.svmep.ch\/svmep\/?p=1546"},"modified":"2025-02-18T09:56:36","modified_gmt":"2025-02-18T08:56:36","slug":"article-61-lpers-sur-le-licenciement-avec-effet-immediat-une-arme-letale-que-lemployeur-doit-rengainer","status":"publish","type":"post","link":"https:\/\/sud.svmep.ch\/svmep\/article-61-lpers-sur-le-licenciement-avec-effet-immediat-une-arme-letale-que-lemployeur-doit-rengainer\/","title":{"rendered":"Article 61 LPers sur le licenciement avec effet imm\u00e9diat : une arme l\u00e9tale que l\u2019employeur doit rengainer"},"content":{"rendered":"<div class=\"wp-block-post-date\"><time datetime=\"2024-11-05T22:28:00+01:00\">5 novembre 2024<\/time><\/div>\n\n<p><strong>Suite au jugement motiv\u00e9 rendu par le Tribunal de prud\u2019hommes de l\u2019Administration cantonale (TRIPAC) dans l\u2019affaire du licenciement avec effet imm\u00e9diat de Philippe Leignel en 2019, la F\u00e9d\u00e9ration syndicale SUD publie un communiqu\u00e9 de presse sur l&rsquo;utilisation qui est faite par l&#8217;employeur public de l&rsquo;article 61 de la Loi sur le personnel (LPers).<br \/><\/strong><\/p>\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>S\u2019il y a plus de quatre fois plus de licenciements avec effet imm\u00e9diat que de licenciements ordinaires, est-ce le reflet d\u2019une pr\u00e9dominance de situations o\u00f9 le lien de confiance est irr\u00e9m\u00e9diablement rompu ou l\u2019expression de la volont\u00e9 de brutalement exercer un pouvoir discr\u00e9tionnaire ? Ce d\u2019autant que le parcours judiciaire en cas de contestation d\u2019une d\u00e9cision est long, les frais de d\u00e9fense \u00e9lev\u00e9s, la sant\u00e9 et les r\u00e9sistances des salari\u00e9\u00b7e\u00b7s liquid\u00e9\u00b7e\u00b7s mis \u00e0 rude \u00e9preuve. En face, les moyens de l\u2019\u00c9tat de Vaud sont pour ainsi dire sans limites. L\u2019employeur public, pour d\u00e9fendre sa position devant le TRIPAC, use \u00e0 discr\u00e9tion de l\u2019argent public, sans jamais en rendre compte.<\/p>\n<\/blockquote>\n\n\n\n<div
